

Fatal Accidents
If a person is killed in an accident then his/her dependants (broadly the spouse and children) are entitled to claim for the proportion of earnings and pension that they have lost as a result of the persons death.
In these cases, we have to agree assumptions about the future lives of the couple with the instructing lawyers, such as the children they would have had and their employment prospects.
Case Study - Dependency Claim
We were instructed to calculate the dependency claim for a lady whose husband was a forklift engineer.
He had unfortunately been killed when the forklift he was working under slipped and crushed him.
A complication in this case was that the company the husband worked for subsequently went into liquidation so we had to look at his alternative employment prospects in order to calculate the loss.
